Margin of Appreciation

A judicial doctrine in rights adjudication that grants national authorities a limited degree of discretion in how they implement or balance certain international human-rights obligations, subject to review by an international or supranational court which assesses whether the state’s choice falls within acceptable bounds of necessity, proportionality, and reasoned justification.
