Necessity

A limiting legal principle or defence permitting conduct that would otherwise be unlawful when (1) an imminent and otherwise unpreventable danger compels action, (2) no lawful alternative exists that would avert the danger, (3) the actor’s response is proportional to the harm avoided, and (4) the actor did not culpably create the danger; precise elements and availability vary by jurisdiction.
